Analyst8 is an AI-powered real estate underwriting platform that converts Offering Memorandums into institutional-grade 10-year DCF (Discounted Cash Flow) models. Our services include:

• Automated extraction of data from real estate offering memorandums
• Generation of financial models and DCF analyses
• Scenario building and sensitivity analysis
• Export to Excel and PDF formats
• Other related features as described on our Site

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

3. Early Access Program

During our early access phase:

• Access to the platform is by invitation only
• Features and functionality may change without notice
• The service is provided "as-is" and may contain bugs or errors
• Early access pricing and terms are subject to change upon full launch
• We may request feedback and use cases from early access users

4. User Accounts and Registration

To access our services, you may need to create an account. You agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Use a valid work email address (not personal email services)

• Process and analyze your documents to provide our services
• Store your data on our servers
• Display your content back to you in our platform

We will NOT:

• Share your User Content with other users or third parties (except as required by law)
• Use your documents or data to train our AI models
• Claim ownership of your User Content

7. Data and Privacy

We implement industry-standard security measures, but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of sensitive information you upload.

You agree to:

• Pay all fees according to the pricing in effect when charges are incurred

All fees are non-refundable unless otherwise stated. We reserve the right to change our fees with 30 days' notice.

9. Disclaimers and Limitations

IMPORTANT: Analyst8 is a software tool that assists with financial modeling. It does NOT provide financial, investment, legal, or tax advice. The models and analyses generated by our platform are for informational purposes only and should not be relied upon as the sole basis for investment decisions.

You are solely responsible for:

• Verifying the accuracy of all extracted data and assumptions
• Reviewing and validating all model outputs
• Making your own independent investment decisions
• Consulting with qualified professionals as needed

9.2 No Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• Data extraction will be 100% accurate
• The models will be suitable for your specific use case
• Any errors or defects will be corrected

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANALYST8 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Analyst8, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of or related to your use of the services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the services at any time, with or without cause or notice, including if:

• You violate these Terms
• Your account is inactive for an extended period
• Your payment is past due
• We discontinue the service

You may terminate your account at any time by contacting us.

Upon termination, your right to use the services will immediately cease. We may delete your data after termination, so please export any content you wish to retain.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the services after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

You waive any right to participate in class action lawsuits or class-wide arbitration.
